is this a tortoise or a turtle

hello we found this little tortoise in the road, hubby nearly run it over with his motor bike

any idea if its a tortoise or turtle?
any idea of age
what sort it is
i live in france where the weather is mild, will it hibernate?

thanks for the great advice so now i know its a tortoise!!! have read up about his sort, so hibernation how will I know when he wants to do that, I remember when I was a kid we had one and we used to put them in straw in a box in the shed for the winter, I expect we will keep him somewhere indoors but it still can get quite cold, so what advice can you give for this

Bonjour!
youve got a little hermanns tortoise that i would say is about 1 and a half.
and yes he will hibernate unless you decide to keep him, in which case you will need to get him a tank and heat lamp for the winter =]

Hi! You have found a Hermann's Tortoise (Testudo hermanni). I think it is a Western Hermann's (Testudo hermanni hermanni) but better pics would help confirm.
